Agrodreams, a trademark of Laishi Group S.A. (hereinafter, “Agrodreams”) values its Users, which is why we want to offer you a safe and reliable service. With this objective, Agrodreams has implemented this Privacy Policy (hereinafter, the “Security and Privacy Policy”) which complies with the security measures required by the Spanish Organic Law 3/2018 on Personal Data Protection and Guarantee of Digital Rights, the European Regulation 679/2016 on Personal Data Protection, the Chilean law 19,628 on Personal Data Protection, the Argentine law 25,326 on Personal Data Protection, the Brazilian federal law 13,709/18 on the General Data Protection Law, and the Uruguayan law 18,831 on Personal Data Protection.

This document describes Agrodreams’ policies and practices regarding the collection, use, processing, and disclosure of personal and non-personal information obtained, compiled, and processed by the Agrodreams App (hereinafter, “Platform”).

By registering, visiting, or using the Platform, whether through the website or through the mobile application, the User is entrusting data and information as a user of the Platform (hereinafter, the “User” or “Users”), and is accepting the practices detailed below.

For this reason, Agrodreams has developed this document with its Privacy Policy to help you understand what data we collect, why we collect it, and what we do with it.

Agrodreams reserves the right to modify this Privacy Policy for various reasons, including the use of new technologies in new versions of the Platform, and/or changes in current legislation. In the event that such a modification affects you regarding the processing of your data, you will be duly informed in the Privacy Policy section. If you do not agree with these changes, you must unsubscribe as a User of the Agrodreams App Platform.

The User is advised to always read the Website’s Privacy Policy whenever they deem it appropriate. 1. What information do we collect?

Agrodreams receives and stores data and information from the User and third parties, data from remote and hyper-localized sensors, and data collected by our system, as described below:

Data and information provided by the User By entering and using the Platform, the User agrees to provide Agrodreams with their personal data, related to their identity or the identity of the company or organization they represent, including, but not limited to, the following: first and last name, address, telephone number, email address, nationality, tax identification number (hereinafter, “Personal Information”).

Agrodreams informs its Users that the personal data they provide will be included in a User database owned by Agrodreams.

Users may also provide opinions, comments, and suggestions by voluntarily participating in surveys and/or answering questions sent via email or from the Platform (hereinafter, “Opinions”). In this case, in order to provide other Users with real testimonials about service experiences on Agrodreams, the User accepts and agrees that all Opinions they send may be published on the Platform and/or on the Website or on other websites and/or applications with which Agrodreams has contractual relationships. By giving us your Opinion, or uploading real photos through the Platform or Website, you are assigning all property rights over said photographs and Opinions to Agrodreams.

Data and information provided by third parties To the extent permitted by applicable law, Agrodreams may also obtain Personal Information from Users and add it to the Personal Information provided by third parties, whether from group companies, allies, and commercial partners and other independent third-party sources, including public databases, information collected during a telephone conversation, and/or through interactive applications. All the information we collect about the User can only be used for the purposes indicated in section 2. Any Personal Information obtained by Agrodreams by the means mentioned here will be treated in accordance with the provisions of this Security and Privacy Policy.

Data generated by remote and hyper-localized sensors and those collected by our systems. Cookie policy. When using the application, the Platform collects, processes, and stores geo-reference and spatial location data (latitude and longitude), data from remote sensors (satellites, airplanes, drones, etc.), from hyper-localized sensors in the field (Internet of things – IoT), and other types of monitors and sensors installed in precision farming machines and equipment, such as planters, pumping equipment, levelers, harrows, sprayers, harvesters, silos, etc.

Agrodreams may collect and process information about your visits to our websites and the Platform. This information may be used to improve the content of the Platform. For these purposes, we may install “cookies,” which are a small set of data that are sent to your browser and stored on your computer’s hard drive. These cookies may be used by Agrodreams or by third parties.

Agrodreams may use Analytics services, based on User behavior (Google Analytics, and others).

In addition, through cookies or a geolocation service based on your connection’s IP or GPS, at Agrodreams we can access your geo-reference location information to provide you with a better service from the Platform.

On the Platform we have content that establishes a link to third-party Websites or services. The User can choose to allow or restrict these services. When a third-party service is enabled, you are authorizing Agrodreams to connect and access other information that is available in accordance with our agreement with the service provider. However, at Agrodreams we do not receive or store passwords for any of these third-party services.

Finally, we inform you that we collect and process location and positioning information when you access the Platform and use our services. For example, to load a management area on a map, it is necessary to collect and record the physical location of your device. The processing of your location data is essential for the services we provide.

From the “Share” functionality you will have control over who you share this and other information with at all times.

2. What is the purpose of processing personal data?

Agrodreams may use your Personal Information for the following purposes:
1. To supply, update, maintain, and protect the Platform’s services.
2. To carry out internal studies on the interests, behaviors, and demographics of Users, to better understand their needs and interests, offer you help and technical assistance, develop new services, and to improve our commercial and promotional initiatives.
3. To develop statistical studies and publicly accessible reports, always ensuring the anonymity of the information used.
4. To prevent or deal with possible errors, technical problems, security issues, or fraud on the Platform.
5. To analyze and control the use, trends, and other activities of Users.
6. To comply with the requirements of applicable laws, regulations, and legal procedures.
7. To communicate with the User in response to their requests, comments, and questions.
8. To develop and provide search, training, and productivity tools, as well as additional functions.
9. For billing, account management, payments, and other administrative matters.

3. Why are we legitimized to process and use your personal data?

At Agrodreams we are legitimized to process and use Users’ personal data to be able to provide our services. In addition, we are also legitimized to process and use your personal information granted by the consent requested from Users.

The User guarantees that the personal data provided to Agrodreams is truthful and is responsible for notifying Agrodreams of any modification thereof.

The User’s acceptance that their data be processed and used for the purposes referred to in this Privacy Policy is always revocable, without retroactive effect, in accordance with the provisions of current legislation.

4. With whom do we share the collected information?

Agrodreams may share and disclose data and information with:

Group companies: Agrodreams may share personal and sensor data and information with any of its affiliated, controlled, controlling, and related companies.
Commercial allies: Agrodreams may share personal and sensor data and information with its commercial allies, with whom it could jointly offer products or services. Said commercial allies are subject to strict confidentiality agreements signed with Agrodreams that prohibit the unauthorized use or disclosure of the information to which they have access. It is clarified that the recipient of the information shared by Agrodreams will assume the same obligations as Agrodreams.
With the competent authorities: Only in the event of receiving judicial requests in accordance with the requirements of the applicable legislation, regulations, and legal procedures in each country.
Among Users: the Platform allows for collaborative work between Users. Only the information that Users wish to share on the Platform will be shared. Likewise, the User may assign and revoke permissions at any time.

5. Where do we store and how do we protect the collected information?

All personal information, data generated by sensors, and images are collected, processed, and stored on servers physically located in the United States, European Union, Brazil, and/or Argentina. By accepting the Privacy Policy, you are accepting that Agrodreams may transfer your Personal Information, data generated by sensors, and images to said countries. In any case, Agrodreams undertakes to guarantee that the legally required standards for the security, protection, and safeguarding of all your data and information collected by the Platform are met.

To guarantee security on our Website, a security system has been integrated that allows the confidentiality and integrity of User data collected through the means mentioned in this Security and Privacy Policy to be maintained.

Agrodreams maintains the levels of security for the protection of your data required by the new legislation and regulations referred to throughout this document, and has made all technical means at its disposal on the Platform to prevent the loss, misuse, alteration, unauthorized access, and/or theft of the data and information that the User provides through the website.

Also, as a User of our Website, they understand, accept, and comprehend that security measures on the Internet are not impregnable and that, therefore, the User is obliged to adopt the necessary security measures that allow them to trust the veracity of the Website where the data is entered. Agrodreams will also do everything possible to guarantee the privacy and security of your identification data at all times, always making use of the utmost diligence and implementing the necessary and appropriate measures.

Agrodreams is not responsible for situations where the User has not implemented the corresponding security measures; nor for their consequences, as well as for causes or damages caused by third parties unrelated to Agrodreams, including fortuitous events and/or force majeure.

6. What data do we retain after deactivating your User account?

In the event that the User unsubscribes from the Platform, Agrodreams is obligated to keep only the personal information for a maximum period of 30 days, so that the User can reverse their decision if they choose to continue using the Platform. After said period, Agrodreams has the right to permanently delete all personal information and data and images generated by sensors of any type, making it impossible to recover them. Likewise, Agrodreams reserves the right to use all non-personal information that the User has entered into the Platform, anonymously, to be used for statistical and/or commercial purposes.

7. What are your rights when you provide us with your data?

The applicable legislation and regulations have implemented a series of legal guarantees that allow the User to exercise rights and actions related to the processing and use of your data.

Agrodreams offers you this legal guarantee, so you can, at any time and/or when you deem it appropriate, exercise your rights of Access, Rectification, Deletion, Limitation of data processing, Opposition, Portability, and not to be subject to automated individual decisions, by writing to the contact email address that we have enabled for this purpose: soporte@agrodreams.com, attaching a copy of your passport or your ID (data owner) and expressly indicating in the subject line the request you wish to make.

Notwithstanding the foregoing, the User must take into account that the information they have shared with other Users, by any means, may continue to be visible and that Agrodreams is exempt from all responsibility with respect to the elimination of this information.

Likewise, Agrodreams does not control the renewal system of third-party search mechanisms, and certain information from the public profile that has already been canceled by Agrodreams may appear in said mechanisms, but still appears on the Internet due to its re-circulation, in which case, we recommend that the User contact those platforms to request their cancellation or the exercise of the right to be forgotten.

We briefly explain what each of the rights that can be exercised consists of:

Right of access: by exercising this right you can know the treatment carried out on your personal data by Agrodreams; its purpose, the origin or its possible transfer to third parties.
Right of rectification: you can correct or modify the data in case it is inaccurate or incomplete to ensure that the information we may have is correct.
Right of Deletion (or right to be forgotten): you can request the deletion of personal data without undue delay, when any of the contemplated cases concur. For example, illicit data processing, or when the purpose that motivated the processing or collection has disappeared. However, a series of exceptions are regulated in which this right will not proceed. For example, when the right to freedom of expression and information must prevail.
Right of opposition: through this right the User may oppose the processing of their personal data: (i) when for reasons related to their personal situation, the processing of your data must cease, unless a legitimate interest is accredited, or it is necessary for the exercise or defense of claims, or (ii) when the purpose of the processing is direct marketing.
Right to limitation of processing: the limitation of data processing may be requested when processing them: (i) when the accuracy of the data is contested, while we verify said contestation, (ii) when the processing is illicit, but the User opposes the deletion of their data and requests the limitation of the processing instead, (iii) when you need them in case of a claim, (iv) and even when you have opposed the processing of your data for the fulfillment of a mission in the public interest, or for the satisfaction of a legitimate interest, which must be verified. In these cases we will only keep them for the exercise or defense of claims.
Right of portability: the portability of the data can be requested in a structured, commonly used and machine-readable format, and to be able to transmit it to another entity, whenever technically possible.

Likewise, at any time, the User may withdraw the consent given without affecting the legality of the processing already carried out, by sending your request to the same address indicated previously. In this case, it is also necessary to accompany the request with a copy of the National Identity Document or an equivalent document that proves the identity of the User.

In Argentina, the Public Information Access Agency has the power to handle complaints and claims filed in relation to the non-compliance with personal data protection regulations.

In Chile, the National Institute of Transparency, Access to Information and Personal Data Protection (INAI) has the power to handle complaints and claims filed in relation to the non-compliance with personal data protection regulations.

8. Social Media Policy

Agrodreams has or will have corporate profiles on the social networks Facebook, Twitter, LinkedIn, Youtube, and Instagram. Therefore, by virtue of the provisions of the applicable regulations, Agrodreams is the “Data Controller” due to the existence of said profiles on these social networks, and in the event that you follow us and we can follow you.

As the data controller for Users on social networks, we guarantee confidentiality in the processing and compliance with your rights, always under the effects of the applicable regulations.

On the other hand, we inform you that we will use these social networks to announce news or relevant information related to the services we offer, or about topics that we consider to be of interest to you. By using the functionalities of these platforms, it is possible that you will receive news with this type of information on your wall or in your profile.

Finally, we inform Users that there is no link between Agrodreams and any social network, so Users will accept the Data Use Policy and other Conditions once they access them and/or validate their notices, terms, and conditions in the registration procedure, and Agrodreams is not responsible for the use or processing of your data by the social network.
